The NES Classic and now most likely the SNES Classic shows that scalpers are the scum of the earth and should be in prison.

It would be nice if Nintendo would pressure Ebay not to allow people to sell the NES or SNES Classic for more than MSRP but I'm not sure how Nintendo could go about doing that.
This signature won't change until Chrono Trigger gets a re-release on a modern Nintendo console.

Blame also needs to fall on NOA for purposely making less than the market desire. I'm not saying that scalpers are innocent; far from it. But if NOA had made enough of the product, scalpers wouldn't have to pull their bulls***.

It would be nice for Nintendo to not do exploitative false shortages, but Nintendo is one of the companies that quite simply hates their consumer base but they have some nice window dressings.

Otherwise I wouldn't have my ROM hack videos DMCA'd.

Nintendo created an artificial scarcity with the NES classic, and most likely the SNES classic.

They cannot. Nintendo lost a similar court battle in the 80's regarding licensing of their games.

Pretty much this. This is a reason I still don't have a Switch. I refuse to pay more than the $300 MSRP for it. Eventually scalpers will give up on that, even if it takes a couple years.
It's like punching a round bottom dummy. We all know it's futile, but occasionally it's fun.

A lot of places are starting to disallow people from buying more than 1 or 2 of an item if it is deemed "scarce". Wal-Mart, for example, limited purchases to two per address of the SNES classic, and Amazon has indicated they will be doing the same. I would bet Best Buy will also follow suit.

This is Nintendo's fault for failing to either produce enough of these products or price them properly. The scalpers aren't doing anything wrong. You should think twice about wanting to make it illegal to resell your games, let alone make it a felony.

Reselling isn't a problem as long as you aren't overcharging people. Scalpers charge 4-5 times the original amount turning something that costs about the same price as a game into the price of a high end console. I don't want to pay 300 dollars for something that originally cost 80.

If Nintendo has any sense, they're probably selling them to scalpers themselves for double MSRP, or just selling them on ebay themselves. Would it really be surprising?

Nintendo screwed up again, but scalpers are scummy.

I am fine with public shaming of scalpers.

Forget Nintendo for a second. Concert tickets are where the real BS is at. Sites like Ticketmaster deserve some blame. I wish the bigger artists would stop using them in protest, but it's possible they may not have the option.

"Overcharging" is entirely subjective. The value is whatever someone will pay. It's not as though anyone is in a position where they HAVE to buy this. If they overcharge, no one buys. If they sell at that price, Nintendo undercharged.
